An Expert Witness is a person whose opinion by virtue of education, training, certification, skills or experience, is accepted by the judge as an expert. The judge may consider the witness's specialized opinion about evidence or about facts before the court within the expert's area of expertise, referred to as an "expert opinion."
As an Expert Witness, the Director of ICVA, Jessica Anlauf may be able to:
- Investigate the facts
- Prepare a report to be submitted to the Legal Proceeding
- Tesify during pre-trial discovery or at trial if necessary
Rule 702. "Testimony by Expert Witnesses" within the Federal Rules of Evidence states: "A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:
(a) the expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;
(b) the testimony is based on sufficient facts or data;
(c) the testimony is the product of reliable principles and methods; and
(d) the expert has reliably applied the principles and methods to the facts of the case."
In determining the qualifications of the expert, the Federal Rules of Evidence requires the expert to have had specialized education, training, or practical experience in the subject matter relating to the case. The expert's testimony must be based on facts in evidence, and should offer opinion about the causation or correlation to the evidence in drawing a conclusion.
Director of ICVA, Jessica Anlauf charges a Flat Fixed Fee: $1500.00 in exchange for the fact finding investigation and final report to be submitted within legal proceedings or to a Federal Agency.
Director Anlauf charges an hourly rate: $100.00/hour for Expert Testimony within court or other legal proceedings. Travel Expenses will be charged additionally, and a fee agreement must be signed prior to purchasing Expert Testimony within a Court or Legal Proceeding.
Director Anlauf will review all of your case information. In addition to reviewing your case, Director Anlauf will then create an individual Case Opinion to be presented within Federal administrative proceedings or other civil proceedings such as:
- United States Citizenship & Immigration Services (USCIS)
- Immigration and Customs Enforcement (ICE)
- Department of Homeland Security (DHS)
- Department of State (DOS)
- Customs and Border Protection (CBP)
- Other (agreed upon agency/department).
- Family Court Proceedings
- Federal Civil Proceedings
*Rules of Evidence may be different depending upon your location. You are responsible for knowing whether expert testimony is permitted within your case. Please ensure you check with your State and Federal Court Rules to ensure Director Anlauf's expert testimony will be accepted prior to sending payment.
Upon receiving all of your documentation and evidence as well as a summary of the events, Director Anlauf will organize and prepare a full case analysis based on Director Anlauf's own expert opinion, experience and expertise, utilizing your supporting documents, as well as supplemental documents or evidence Director Anlauf obtains through any of her own research.
Director Anlauf create an Expert Opinion Report including:
- -Brief Summary of Case
- -Case Analysis Describing Fact Findings
- -Director Anlauf's Expert Opinion + Supporting Documents/Evidence
- -Recommendation to USCIS/ICE/DHS/DOJ or Other (agency/department as appropriate)
Once the case opinion is complete the Director will mail or email (or other as required by the agency) the Report to the appropriate agency/department(s). The Director will also provide you with a copy of the Director's Report for your personal records.
*Reports are based solely on the opinion of the Director, and based solely on the evidence provided by you in conjunction with other research performed by the Director. The Report the Director provides may not be the result you are hoping for. In other words, the Director may find that there was no misconduct in the Director's expert opinion. Director Anlauf and ICVA maintain an extremely high standard of ethics and quality, and therefore Director Anlauf must provide honest and impartial work.
